The mother, 52-year-old Susana Cruz, was also thrown from her car, at a distance of about 100 feet.  Both Kane and Cruz were taken to the hospital and pronounced dead on the scene.

State Legislator Seeks to Ban Texting While Driving

Posted on February 16th, 2009 No Comments

It is common sense that activities like texting or talking on the phone can be dangerous while driving, but Florida State Sen. Carey Baker has proposed legislation seeking to make these activities a crime under state law.  In fact, Baker has proposed two similar laws designed to make drivers focus on the road.  One of the laws bans texting by all drivers, while the other also bans talking on the phone by minors.

Several other states including Washington and Minnesota have already passed bans on texting, as have a number of cities across the country.  Studies have shown that texting, in particular, leads to a higher risk of accidents, causing drivers to drift in and out of traffic lanes.

Under Baker's proposal, texting while driving would result in a traffic violation punishable by a $60 fine.

Baker himself noted that he sometimes talks on the phone while driving, arguing that there are often legitimate reasons for doing so.  However, he said he never uses text messaging while in the car.

Texting while driving puts everyone on the road in danger.  If you or someone you know has been the victim of an automobile accident caused by such activity, it is important that you have expert legal representation.  Contact the Orlando personal injury lawyer Todd Miner by phone at 407-420-4040 for more information.

Judge Finds Mom Liable in Underage Drinking Case

Posted on February 16th, 2009 2 Comments

Parents of teenagers know that they are generally responsible for the actions of their children.  However, parents are increasingly being held legally responsible for the activities of their children's friends, particularly when it comes to underage drinking.

In a case that further proves this point, a judge has found an Illinois mom liable for $2.5 million in damages resulting from a party in which underage drinking occurred.  Lauralee Pfeifer was found to be responsible for 19 year-old George Baldwin, who became intoxicated at her home after being invited there by Pfeifer's teenage daughters.  After leaving the party, Baldwin was involved in a car accident in which he was paralyzed from the chest down.

Judge Christopher Starck ruled in favor of Baldwin, stating that Pfeifer did not take adequate action to prevent the drinking, despite opportunities to do so.  Judge Starck awarded Baldwin $2.5 million, which represents the amount of Pfeifer's homeowner's insurance.

A Cape Coral teenage girl was awarded $12.2 million dollars as a result of an accident that occurred in 2003.  The accident resulted in the teenager to be paralyzed from the waist down.

The accident occurred  outside of Orlando in 2003.   The girl was 15 years-old when a truck rear-ended the vehicle her grandfather was driving. The girl was immediately paralyzed and said she was not able to feel her legs at the scene of the accident.  The teenagers grandmother, who was also in the car, was awarded over a million dollars as a result of injuries she suffered from the accident.

Although the amount rewarded is huge,  the money may not be paid out right away. The case is likely to be appealed which could result in a delay of the payments.
